Smile Academy Terms & Conditions
- Definitions
1.1 “Smile Academy” refers to Smile Academy Pty Ltd, an Australian limited liability company specialising in the design, manufacture and distributing of dental appliances.
1.2 “Customer” refers to the dental practitioner or dental practice engaging Smile Academy’s services.
1.3 “Products” encompass all dental appliances provided by Smile Academy, including but not limited to clear aligners, retainers, wired retainers, occlusal splints, sleep apnea/anti-snoring appliances, crowns, veneers, bleaching trays, and mouthguards.
1.4 “Services” refer to the professional design and manufacturing services offered by Smile Academy related to the Products.
- Acceptance of Terms
2.1 By engaging Smile Academy’s Services or ordering Products, the Customer agrees to be bound by these Terms and Conditions.
2.2 Smile Academy reserves the right to amend these Terms and Conditions at any time. Continued engagement with Smile Academy’s Services constitutes acceptance of any revised terms.
- Payment Terms
3.1 Payment for all invoices is due within fourteen (14) days from the invoice date.
3.2 Late payments may incur interest charges at a rate determined by Smile Academy, in accordance with applicable laws.
3.3 Smile Academy reserves the right to suspend Services or withhold Products if payments are overdue.
3.4 Our standard payment terms are strictly fourteen (14) days from the invoice date. If any invoice remains unpaid beyond sixty (60) days, Smile Academy reserves the right to engage a debt collection agency to recover the outstanding amount. All fees, charges, or commissions incurred in the process of debt recovery will be added to the outstanding balance and will be payable by the Customer.
- Treatment Planning Responsibility (for clear aligners and retainers)
4.1 Smile Academy provides design proposals for dental appliances in collaboration with partners such as 3Shape and SoftSmile.
4.2 The Customer acknowledges that all treatment planning decisions rest solely with the dental practitioner. Smile Academy’s design proposals are recommendations until validated by the dental practitioner.
4.3 It is the responsibility of the Customer to thoroughly review and approve all design proposals before proceeding. Smile Academy is not liable for any outcomes resulting from the Customer’s treatment decisions.
- Service and Delivery
5.1 The Customer is responsible for ensuring that all impressions, scans, and other necessary materials provided to Smile Academy are accurate and meet industry standards.
5.2 Smile Academy will endeavour to complete and deliver Products within standard turnaround times. However, delays may occur due to unforeseen circumstances, and Smile Academy is not liable for any such delays.
5.3 Delivery costs will be outlined in the invoice and are the responsibility of the Customer.
- Warranty and Liability
6.1 Smile Academy warrants that all Products are free from defects in workmanship and materials at the time of delivery.
6.2 This warranty does not cover defects arising from improper use, handling, or storage by the Customer or their patients.
6.3 Smile Academy’s liability is limited to the repair or replacement of defective Products, at its discretion. No liability is accepted for any indirect or consequential losses.
6.4 The Customer agrees to indemnify and hold harmless Smile Academy against any claims arising from the use of the Products, except where such claims result from Smile Academy’s negligence or breach of these Terms and Conditions.
6.5 Liability and Indemnification Regarding Clear Aligner Devices
Smile Academy does NOT agree to indemnify, defend, or hold the Customer harmless against or from any claims, causes of action, or damages to any third party arising out of or resulting from the use of Smile Academy’s products, the Smile Academy Platform, or any defect in any dental product manufactured. In addition, the Customer agrees to fully indemnify, defend, and hold Smile Academy harmless from any and all claims, causes of action, or damages arising out of or resulting from any defect in any clear aligner devices produced or manufactured using Smile Academy’s products and/or the Smile Academy Platform. This includes, but is not limited to, any claims of bodily injury, property damage, or any other form of injury resulting from such defects, whether such claims are made by the Customer’s patients or otherwise.
6.6 Patient Harm and Clinical Outcome Disclaimer
Smile Academy is not responsible or liable for any injury, pain, discomfort, or harm suffered by a patient as a result of using any Smile Academy Product. This includes, but is not limited to, orthodontic misalignment, tooth movement, loss of teeth, damage to teeth, gums, bones, or surrounding oral structures, or where the end result does not match the proposed treatment plan. The Customer acknowledges that all treatment plans and clinical decisions are the sole responsibility of the prescribing dental practitioner, and that Smile Academy acts only as a manufacturer of dental appliances based on the specifications provided. The Customer agrees to indemnify and hold Smile Academy harmless from any claims, demands, liabilities, or actions brought by patients or any third party in connection with the use of Smile Academy Products.
- Governing Law
7.1 These Terms and Conditions are governed by the laws of the State of Queensland, Australia.
7.2 Any disputes arising under these Terms and Conditions shall be resolved in the courts of Queensland.
- Confidentiality
8.1 Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the course of their business relationship.
8.2 This obligation extends beyond the termination of the business relationship.
- Intellectual Property
9.1 All intellectual property rights associated with the design and manufacture of the Products remain the property of Smile Academy.
9.2 The Customer is granted a limited, non-exclusive licence to use the Products for their intended purpose.
- Miscellaneous
10.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.2 These Terms and Conditions constitute the entire agreement between Smile Academy and the Customer, superseding any prior agreements or understandings.

1. General
Smile Academy (“we”, “our”, “us”) operates this online shop to provide dental and oral care products to customers in Australia.
By placing an order, you confirm that you are at least 18 years old or have permission from a parent/guardian.
2. Orders & Payments
All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.
Payment must be made at the time of purchase. We accept major credit cards and other payment methods shown at checkout.
Once an order is placed, you will receive an email confirmation.
3. Shipping & Delivery
We ship Australia-wide using trusted courier and postal services. (Australia Post)
Delivery times are estimates only and may vary depending on location. We are not liable for delays caused by third-party carriers.

4. Refunds & Returns
We want you to be happy with your purchase.
4.1 Change of Mind:
You may return unused and unopened items within 14 days of delivery for a refund (excluding shipping costs).
Items must be in their original packaging and condition.
4.2 Faulty or Damaged Goods:
If your product arrives faulty, damaged, or incorrect, please notify us within 7 days of delivery.
We will arrange a replacement or full refund, including return shipping.
4.3 Exceptions:
For hygiene and safety reasons, certain products (e.g. opened dental or oral care items) cannot be returned unless faulty.
4.4 Refund Process:
To request a return, contact us with your order number and details.
Refunds will be processed to your original payment method within 7-14 business days after the returned item is received and inspected.
5. Product Information
We make every effort to ensure that product descriptions, images, and pricing are accurate.
We reserve the right to correct errors, update information, or change product details without prior notice.
6. Liability
Smile Academy is not liable for any indirect or consequential loss arising from the use of our products.
